Abstract
Ugovor o zakupu broda u hrvatskom je pravu reguliran Pomorskim zakonikom. Radi se o dvostranopravnom odnosu između zakopodavatelja i zakupoprimatelja. Zakupodavatelj daje zakupoprimatelju brod na uporabu za obavljanje plovidbene djelatnosti, a zakupoprimac se obvezuje platiti zakupninu. Za ugovor o zakupu obavezna je pisana forma, odnosno ugovor je formalan. U radu je dan pregled ugovora o zakupu prema hrvatskom pravu - prema Zakonu o obveznim odnosima i Pomorskom zakoniku; sklapanje i sastojci ugovora, prava i obaveze stranaka te prekid ugovora. Kao primjer tipiziranog ugovora o zakupu broda dan je TANKERVOY 87 - ugovor o prijevozu tereta u tankerskom brodarstvu
Abstract (english)
In the Croatian law the ship charter contract is regulated by the maritime law. It is a bilateral legal relationship between the lessor and the lessee. The lessor gives to the lessee a vessel for maritime activities and the lessee undertakes to pay the rent. For the charter contract, a written form, charter party is required. This thesis provides an overview of ship charter contracts in accordance with the Croatian law – according to the Civil Obligations Act and Maritime law; conclusion of agreement and its components, rights and obligations of the parties and the termination of the contract. As an example of the charter contract, TANKERVOY 87 is given – contract of carriage in the tanker shipping sector.
