Abstract
Istraživanjem i analizom brodarskog ugovora na putovanje, nastojale su se prepoznati i definirati njegove najbitnije sastavnice i elementi. Osim bitnih elemenata proučeno je hrvatsko zakonodavstvo, kao i međunarodne konvencije i organizacije koje su u korelaciji sa ovim ugovorom. Pomoću deskriptivne metode korištene u ovom radu rasvijetlio se način izvršavanja ovog ugovora uzimajući u obzir samo njegove najvažnije odrednice iz razloga što je gotovo nemoguće ukomponirati sve odrednice u jedan istraživački rad. Nadalje, proučavanje procesa provedbe ovog ugovora u praksi koje stvaraju subjekti pomorskog prijevoza, odnosno stranke ugovora pridonijelo je opširnim elaboriranjem prikupljenih činjenica. Rezultat svih istraživanja i analiza ovog ugovora i GENCON obrasca doveo je do zaključka da je ovo vrlo praktičan i često korišten ugovor među prijevoznicima i naručiteljima te da je potrebna vrlo neophodna pažnja stranki ugovora prilikom definiranja uvjeta i izrade, tj. prilagođavanja standardnog GENCON obrasca.
Abstract (english)
The main intent of researching and analysing Voyage Charter, was to recognize and define its core components and elements. In addition to essential elements, Croatian legislation, as well as international conventions and organizations that are in correlation with this agreement, have been studied. Using the descriptive methods used in this paper, it clarified how this Voyage charter is executed, taking into account only its most important determinants, due to the fact that it is almost impossible to incorporate all the determinants into one research work. Furthermore, the study of the process of implementation for this charter party in practice created by the parties to the contract, has contributed to the extensive elaboration of the collected facts. The result of all the research and analysis of this Voyage charter and the GENCON form led to the conclusion that this is a very practical and often contracted charter party between shipowners and charterers. Also it is necessary to require attention when defining and drafting the conditions and rider clauses in the GENCON form.
